Planned Parenthood of Indiana and Kentucky has filed a federal lawsuit against the Indiana  for a new law regulating abortions obtained by minors.

The organization seeks an injunction to stop enforcement of the law, which the suit calls "constitutionally deficient," from going into effect.

Senate Enrolled Act 404 proposes the possibility of notifying a minor's parents that she's seeking to obtain an abortion without their consent.


Proponents call the bill an expanded protection of parental rights, but opponents see as an additional hurdle to a woman's right to choose.

The 21-page lawsuit, naming the State Department of Health Commissioner, prosecutors from Marion, Tippecanoe, Lake and Monroe Counties, among others, was filed Thursday morning.

Republican supermajorities in the two legislative chambers supported the parental notification legislation, with the Senate sending it to Gov. Eric Holcomb with a final 31-10 vote Thursday.

Still, a few Republicans opposed it, including Sen. Vaneta Becker, R-Evansville, who said she felt it did not protect teens in foster care.

Those younger than 18 must either have parental consent to obtain an abortion, or they can petition the court to waive parental consent for an abortion. If they petition the court, Senate Bill 404 adds a provision that a young woman's parents would be notified of her intent to seek an abortion before the procedure — unless the judge decides it's in her best interest to withhold that notification.

The bill also requires a parent, guardian or custodian accompanying a minor to provide proof of their identity and relationship when providing consent for her to obtain an abortion. It makes it a felony for a person to pose as a minor's parents in order to circumvent the parental notification requirement.
